Terms of Service
These Terms of Service (“Terms”) are an agreement between RentalLeak (“RentalLeak”, “we”, “us”) and the company or person that creates an account (“you”, “Customer”). By creating an account or using the RentalLeak mobile or web application (the “Service”) you agree to these Terms. If you are agreeing on behalf of a company, you represent that you are authorised to bind that company.
1. The Service
RentalLeak is a rental-cost tracking tool for contractors. It helps you record rented equipment and jobsite costs, read rental agreements and invoices, track billing rollover dates, coordinate KEEP / off-rent decisions between the field and the office, and — on the Pro plan — review vendor invoices and run spend reports. We may add, change or remove features over time.
2. Accounts and team members
You must provide accurate account information and keep it current. The first user for a company is its owner. You are responsible for your team’s use of the Service, for keeping login credentials secure, and for all activity under your account. Tell us promptly if you believe an account has been compromised. Each plan has a limit on the number of active users; that limit is enforced by the Service.
3. Subscriptions, trials and billing
- Plans. Paid plans are billed monthly in advance at the price shown on our pricing page for the plan you select. Prices are in US dollars unless stated otherwise.
- Free trial. New accounts may receive a 30-day free trial. At the end of the trial, if no paid plan is in place, the account moves to a read-only state — your existing data remains visible but you cannot create new rentals until you choose a plan. We do not charge a card without a plan on file.
- Payment processing. Payments are handled by Stripe. By subscribing you authorise us, through Stripe, to charge your payment method on each renewal until you cancel.
- Changes. Upgrades take effect immediately; the price adjusts on your next invoice or as a prorated charge. Downgrades take effect at renewal and are blocked while your team exceeds the smaller plan’s user limit — we never remove your team members for you.
- Taxes. Prices exclude any applicable taxes, which you are responsible for.
- Price changes. We may change plan prices with at least 30 days’ notice before your next renewal.
4. Cancellation
You can cancel at any time from the billing area of the app. Cancellation stops the next renewal; access continues until the end of the paid period. Except where required by law, payments already made are non-refundable. After cancellation your data is retained subject to our Privacy Policy until the account is deleted.
5. Data accuracy — your responsibility to confirm financial facts
RentalLeak reads rental agreements and invoices using automated and AI-assisted extraction. Extracted values are suggestions only. They may be incomplete or wrong. The Service is designed so that a rate, billing period or date you have not confirmed is marked “needs review” and is excluded from dollar figures and reminders — but you remain solely responsible for reviewing and confirming every rental’s terms, for verifying vendor invoices, and for any decision to keep, return or pay for a rental. Rollover dates, next-charge amounts, estimated savings and invoice comparisons are calculations and estimates provided for your convenience and are not a guarantee of what a vendor will bill or honour.
6. Acceptable use
You agree not to:
- break the law or infringe anyone’s rights when using the Service;
- upload content you do not have the right to upload, or that contains malware;
- attempt to access another company’s data, probe or bypass security, or disrupt the Service;
- reverse engineer, resell or provide the Service to third parties except your own team;
- use the Service to build a competing product, or scrape it with automated tools.
We may suspend access for conduct that violates this section or that poses a risk to the Service or other customers.
7. Your content
You keep all rights to the rentals, documents and other content you put into the Service (“Customer Content”). You grant us a limited licence to host, process, transmit and display Customer Content solely to provide and support the Service, including sending it to our AI extraction provider to return field results. We do not use Customer Content to train third-party AI models.
8. Our intellectual property
The Service, including its software, design, and the RentalLeak name and logo, is owned by RentalLeak and its licensors and is protected by intellectual-property law. These Terms grant you a non-exclusive, non-transferable right to use the Service during your subscription. Feedback you send us may be used without restriction.
9. Third-party services
The Service relies on third parties including Supabase, Stripe and Anthropic. Your use of the Service is also subject to their terms where applicable, and we are not responsible for their acts or omissions.
10. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that extracted data or calculations will be accurate or complete.
11. Limitation of liability
To the fullest extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or rental costs, arising out of or related to the Service. Our total liability for any claim arising out of or related to these Terms or the Service will not exceed the amount you paid us for the Service in the 12 months before the event giving rise to the claim.
12. Indemnification
You will defend and indemnify RentalLeak against third-party claims arising from your Customer Content or your use of the Service in breach of these Terms, to the extent permitted by law.
13. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms and do not cure the breach within a reasonable time, if required by law, or if providing the Service to you becomes commercially impractical. On termination your right to use the Service ends; data handling follows our Privacy Policy.
14. Changes to these Terms
We may update these Terms. If a change is material we will update the date above and provide reasonable notice. Continued use after a change takes effect means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of [State/Country — to be set by RentalLeak before public launch], without regard to its conflict-of-laws rules, and any dispute will be brought in the courts located there, unless applicable law gives you a non-waivable right to bring it elsewhere.
